1. Agreement to Terms

By accessing and using SmartMail ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of the terms, you may not access the Service.

2. Use License

Permission is granted to temporarily use the Service for personal or commercial use. This is the grant of a license, not a transfer of title, and under this license you may not:

• Modify or copy the materials
• Use the materials for any commercial purpose without prior written consent
• Attempt to reverse engineer any software contained in the Service
• Remove any copyright or other proprietary notations from the materials
• Transfer the materials to another person or "mirror" the materials on any other server

3. User Accounts

When you create an account with us, you must provide accurate, complete, and current information at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account.

You are responsible for:

• Maintaining the confidentiality of your account and password
• Restricting access to your computer and account
• All activities that occur under your account or password

4. Acceptable Use

You agree not to use the Service to:

• Send spam or unsolicited emails
• Violate any laws or regulations
• Infringe upon the rights of others
• Distribute malware or harmful code
• Impersonate another person or entity
• Interfere with or disrupt the Service

5. Subscription and Billing

Some parts of the Service are billed on a subscription basis. You will be billed in advance on a recurring and periodic basis ("Billing Cycle"). Billing cycles are set on a monthly, semi-annual, or annual basis.

At the end of each Billing Cycle, your subscription will automatically renew under the exact same conditions unless you cancel it or we cancel it.

6. Refunds

Except when required by law, paid subscription fees are non-refundable. If you cancel your subscription, cancellation will take effect at the end of the current paid term.

7. Content

Our Service allows you to post, link, store, share and otherwise make available certain information, text, graphics, or other material ("Content"). You are responsible for the Content that you post on or through the Service.

By posting Content on or through the Service, you grant us the right and license to use, modify, publicly perform, publicly display, reproduce, and distribute such Content on and through the Service.

8. Intellectual Property

The Service and its original content (excluding Content provided by users), features and functionality are and will remain the exclusive property of SmartMail and its licensors.

9. Termination

We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms.

10. Limitation of Liability

In no event shall SmartMail, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Service.

11. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will provide at least 30 days notice prior to any new terms taking effect.
